The President's Ignoring Legislative Process and Writing Regulations Instead. Any Leftists Concerned About This?

This egoist person fulfilling the office of the President of the United States, thinks he’s above the law; not that his job is to enforce it and the Constitution. I’ve written previously about his abuse of power here. The Left/Dems are certainly taking the short view of using regulations and executive orders to circumvent laws for short term political gain.

The idea they have is short term political gain, not the law and not the Constitution, but to force their ideology upon Citizens. Obama says this is necessary because he’s being blocked by Republicans. Currently there are over 300 bills the Republican controlled House has passed and sent to Congress. It turns out there’s usually that many pending bills waiting in the Senate regardless of who’s ruling that roost. It’s been that way for years, even decades.

The lie of the president is that Republicans are obstructing, not passing bills. All his pet subjects, immigration and environmentalism especially, aren’t getting passed with the outcome he wants. Harry “Dusty” Reid, president of the Senate, has refused to bring any of the legislation passed by the House on those and other subjects for debate and voting for political reasons. They have gone five or six years not passing a budget as required by law. Democrats, with the president, do not obey the law, and there’s no punishment.

Previous presidents dealt with opposition to policies they wanted to enact legally. They found a way to enlist the help of the citizens that forced the hand of legislators (Reagan was brilliant at this) or rewrite a compromise, which is what politics is about. It tempers extremism on both sides of the aisle. Not this guy. He’s a totalitarian extremist. His way or the highway.

Thus we had the issue with the National Labor Relations Board (NLRB). He sent up names of extreme Leftist union thugs for nomination that were not approved by the opposition. Democrats had previously when blocking Republican nominations, set up minute long sessions every three days to keep congress in session so the president couldn’t do “recess appointments”. Republicans used that Democrat tactic. Obama, like the totalitarian he is, appointed his union thugs anyway. It went to the Supreme Court, he lost (even the Leftists on the Court agreed so the ruling was unanimous) because congress was in session. What he did by making the appointments was illegal.

His current pet project is to open the border to Mexico, Central and South America. The political opposition wants to secure the border and enforce the laws regarding immigration. The president couldn’t get the DREAM act passed through legislation, so he ignored it, and wrote a regulation that was in fact the DREAM act (Deferred Actions for Childhood Arrivals [DACA] and made legal lots of illegal [estimated over a million] (criminal) invaders of our country legal.

That’s just a couple of issues as examples of his violating the Constitution, ignoring legislation, and flat out using his totalitarian mindset to force his ideology and hunger for political power upon the citizens.

Imagine if a Republican president had this totalitarian mindset? One of Conservative’s political ‘what if’ games is if a Republican, Christian or Conservative did something a secularist or Leftist did, what would be the consequence. Can you imagine if a Republican president did the same, and for example just wrote executive orders dismantling ObamaCare? How about an executive order not enforcing tax laws on corporations. How about executive orders stating citizens could opt out of ObamaCare if they created a payroll deduction for a medical savings account, or opt out of Social Security if they had payroll deduction for a retirement account. Just going crazy here, how about an executive order that all Democrats could not take tax deductions because we want to help them walk the talk of supporting massive government. That way they wouldn’t be hypocrites. Sorry about the unrealistic last statement, just couldn’t pass it up.

But who, before Obama, thought any president would just ignore the constitution and write legislation and get away with it?

The totalitarian we have running the executive branch, just like his Leftist anti-freedom, anti-Constitutional political party, I think are counting on the Republican Party and Conservatives not to act the same way when they get back in power. Then again I’m thinking, they probably think they will never be out of power. Pray they are wrong.

Crippled Water Foul [sic]

Naming the congressional session or presidential term after crippled water fowl when they are between terms, or headed out of office, goes back to England. A lame duck was originally a businessman that couldn’t pay his debts, and in the 1800’s started being used to identify politicians after elections and in between terms or sessions.

In 1933 the 20th amendment moved the starting of new sessions and terms for congress and president from March to January. This was done to close a power vacuum between administrations and congresses, and to reduce the chance of politicians to do even more harm to the country since they had nothing to lose, having already lost.

Historically lame duck congresses have not met, the thinking being, correctly, that if they had been voted out of power, they shouldn’t be passing legislation. Dems are more likely to do this, as they did in 1980 when pro-PLO and Hamas supporter and anti-Semite Jimmy Carter and the Dem congress passed the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 in December before the new congress and Reagan came to power.

The controlling, greedy, power mad current congress, having been tossed out on their tin ears, are going to try and get their rejected agenda through in these last weeks of the year. Not surprised since they passed ObamaCare against the will of the people around midnight on Christmas Eve last year. Stealth legislation in the dead of night. This from the Administration that came to power stating they would drain the swamp, and have open and transparent governance.

The cowardly Dems closed congress before passing any economic legislation before the election. They didn’t even pass a budget as required by law. The rest of their Statist agenda was left pending. Still, the Dems will become a dumb duck session trying to pass all this stuff. “Don’t ask don’t tell” which is just a stupid debate. Who cares who you’re poking, just shut up about, anywhere, in or out of the military, and do your damn job. Then there’s the budget, which should have been done months ago, and related to that is whether to let the Bush tax cuts expire. Truly, it should be called the Obama tax increase. Then there’s the “Dream Act” which is a nightmare. Truly, we want illegal immigrants to pay in state tuition when our own citizens can’t afford college?

Then there’s ratification of the START treaty. I hope at least some of these congress critters have read it (unlike most legislation), and it should be put off anyway until the next session. These guys have been sitting on their collective asses on this, so it can wait. Let’s see, we have environmental legislation, part of which makes the gas you exhale while breathing illegal. These are the same knuckleheads saying we of the great unwashed ignore and are ignorant of science.

What else do they want to pass legislation on? Chinese currency and trade policy, food safety, which they tell us what we can eat and child nutrition policy telling us what we can feed kids, the Elementary and Secondary Education Act reauthorization (after education has received $billions of ‘stimulus’ money), passing a renewable electricity standard and yet more stuff. About twenty bills total they want to address. In less than eight weeks.

Many of these congress critters have been fired. This is like an incompetent employee being fired and still coming to work. We need to amend the 20th amendment to state that congress shall not meet after elections unless it’s a national emergency that requires their attention. Even then it would be better to keep them out of Washington DC. If these dumb ducks cared about the citizens like they say, they should embrace the chance to stay home in their districts with the folks for a couple months. Especially during the holiday season.

The Haircut

An oldie, but time is running down. 36 days!

THE HAIRCUT
One day a florist went to a barber for
a haircut. After the cut, he asked
about his bill, and the barber
replied, 'I cannot accept money from
you, I'm doing community service this
week.'
The florist was pleased and left the
shop. When the barber went to open his
shop the next morning, there was a
'thank you' card and a dozen roses
waiting for him at his door.

Later, a cop comes in for a haircut,
and when he tries to pay his bill, the
barber again replied, 'I cannot accept
money from you , I'm doing community
service this week.' The cop was happy
and left the shop. The next morning when
the barber went to open up, there was
a ' thank you' card and a dozen donuts
waiting for him at his door.

Then a Congressman came in for a
haircut, and when he went to pay his bill,
the barber again replied, 'I can not
accept money from you. I'm doing
community service this week.' The
Congressman was very happy and left
the shop. The next morning, when the barber
went to open up, there were a dozen
Congressmen lined up waiting for a
free haircut.

And that, my friends, illustrates the
fundamental difference between the
citizens of our country and the
politicians who run it.

BOTH POLITICIANS AND DIAPERS NEED TO
BE CHANGED OFTEN AND FOR THE SAME
REASON!

Democrats' Thoughts on the Constitution...In Their Own Words

I thought it was my imagination, that I keep hearing the words, and seeing the legislation, and wondering, how’s that happening, that’s not in the Constitution.

Here’s some of what Dems, Leftists, Statists, that whole side of the aisle say about the Constitution.

There’s a writer for the Leftist magazine, “Slate” and her response to Candidate Christine O’Donnell’s statement:  “…when I go to Washington, D.C., the litmus test by which I cast my vote for every piece of legislation that comes across my desk will be whether or not it is constitutional.” The writer, Dahlia Lithwick, pondered: “How weird is that, I thought. Isn’t it a court’s job to determine whether or not something is, in fact, constitutional? And isn’t that sort of provided for in, well, the Constitution?”

My understanding is congress critters, when sworn into office, swear to uphold the Constitution.

Another question arose, when the current Republican “Pledge to America” stated they would, and this isn’t a new idea, have a tag on new legislation saying what article in the Constitution allows that law. Make sense to me. We’re supposed to be informed by it when passing laws, so where in there is it? Susan Milligan for US News & World Report: “Just plain wacky.” Truly? I remember even writing papers in school, we had to document and footnote our sources. Seems sensible to me that people passing laws to enhance their lives and ruin ours, could at least take a moment and do a fantasy check.

I have a vague memory from civics class way back in the 1960’s that the government has “enumerated powers.” Dems and RINO’s have tossed that concept out a long time ago. I remember posting a vid of Rep. James Clyburn (Statist., S.C.) saying: “There’s nothing in the Constitution that says that the federal government has anything to do with most of the stuff we do.” These guys really do believe they have the power to do anything they want. They do not care, nor understand what’s in the Constitution, and they certainly don’t want citizens to make their own choices about how to live their own lives.

They will tell you what light bulb you can burn in your house, what temperature your house should be, what health care program you can have and what health care will be provided to you, how much energy you are allowed to consume, force your kids to attend a failed school system, the list can go on forever.
 Rep. Phil Hare (Statist., Ill.):

Finally there’s Nancy Pelosi: “Are you serious?” responding to a question about where in the Constitution it allows them to pass all the measures in the health care bill. Truly?

Do we really want people passing laws they exempt themselves from, that ignore the Constitution, tell us how to live our lives and will punish us with prison or fines if we don't obey, plus tell us how much of the money we earn we get to keep?

That Sucking Sound You Hear Isn't Oil Being Skimmed

The sucking sound you do hear is the vacuum left by the lack of leadership from the White House. I've been writing since the second month of the Obama administration that this guy is a whinny crybaby that has no leadership skills. Because of his lack of any management experience, he can't even handle daily events, let alone an emergency like we have in the Gulf. The crybaby perception is the result of his blaming, over a year and a half into his administration, GW Bush for all his problems. Top rule of leadership is to never say anything about your predecessor.

I ranted in an earlier blog about his do nothingness regarding the Gulf oil disaster. We shouldn't be surprised. This is a guy that voted "present" on nearly every issue when he was in the Illinois Senate, and did the same in the US Senate. In the US Senate, to be fair, he missed a lot a votes because he was out campaigning right after he was elected to that once honorable body. So sometimes he didn't vote "present". He avoided making decisions then, never had to make any decisions before that in his professional life, and is avoiding making decisions now.

His lack of ability to lead or even manage, due to cowardice, has led to the dismissal of a fine General, General Stanley McChrystal, U.S. commander in Afghanistan. Obama is Commander in Chief, and when in command, there has to be solid missions set out and adhered to until completion. In the military there's flexibility to adjust to the situation on the ground. In Obama's oligarchy, he has academics and political operatives that have no understanding of the military. If the top of the command structure is in disarray, then the subordinates will reflect that. McChrystal and his staff were wrong in what they did, but when their boss and his staff are incompetent, argue about the results they want what the mission is, it's a problem. Defense Secretary Robert Gates, Vice President Biden, Gen. David Petraeus, Richard Holbrooke and their staffs all argue about the mission in Afghanistan, sending mixed messages to the Military. I guarantee you this is felt all down the ranks, and is seriously demoralizing. I experienced it first hand while in the Navy during the Carter administration. Remember, McChrystal asked for 40,000-45,000 additional troops for optimal success of the mission in Afghanistan, and after 10 months of waiting he got 30,000 promised, plus a deadline for end of the campaign. The inept Obama does not understand that if you tell your enemy your intentions, he will exploit it and kill your troops while doing other serious damage. US troop deaths are up. No surprise there. The Afghanistan mission is on the road to failure. I think that because Obama is so incompetent, the US Military should be withdrawn from the theater before he gets anymore servicemen killed.

Then there's the disaster in the Gulf, and right now 59% of the American people don't think he's handling it well. My thoughts on Obama's incompetency and inability, along with timeline of events and non-action here.

Money. Yesterday or the day before it was announced that the Democrat controlled Congress won't pass a budget, which is mandated by the Constitution. Actually it's one of the few things the Constitution says is a duty of the government. I'm not sure, but I don't think, at least in my lifetime, that Congress has not submitted a budget. I haven't even heard if Obama submitted a budget. Usually by this time of the legislative year, if there were a Republican president, we'd be hearing the Jurassic Press saying "the president's budget is dead on arrival". After looking at a $1.3 trillion increase in spending in about a year, the largest increase in domestic spending since WWII, and a multi-$trillion increase on a massive health care and insurance bill with no way to pay for it, this country is on track to have it's debt exceed the value of the assets of the country. No leadership here. He simply doesn't know what to do. He doesn't understand economics any more that he understands the military.

He's failed with the economy. He's failed with the military. He's failed with the crisis in the Gulf. The enemies of Western Civilization are rattling their sabers even louder because they know he's weak and a coward. We are in grave danger because an indecisive child is in a man's position of power.

Congress and Wall Street (cartoon)

Can Obama and Congress Order You to Buy Broccoli? By Terence Jeffrey

Can President Barack Obama and Congress enact legislation that orders Americans to buy broccoli? If so, where did they get that authority? What provision in the Constitution empowers the federal government to order an individual to buy a product he does not want?

This is not a question about nutrition. It is not a question about whether broccoli is good for you or about the relative merits of broccoli versus other foods. It is a question about the constitutional limits on the power of the federal government. It is a question about freedom.

Can President Obama and Congress enact legislation that orders Americans to buy health insurance? They might as well order Americans to buy broccoli. They have no legitimate authority to do either. Yet neither Obama nor the current leadership in Congress seems to care about the constitutional limits on their power.

Pelosi Drains the Swamp-Not

Remember when the Dems were voted into the majority in Congress, and Pelosi said the culture of corruption will end, and transparency and honesty would reign supreme?

Charlie Rangel, Ways and Means Committee Chairman, that writes laws to take away the money you make to pay themselves and buy power, aka taxes, is even a bigger tax cheat than "tax cheat" U.S. Treasury Secretary Tim Geithner. Geithner is responsible for the IRS, the tax guys. We know he didn't pay taxes for years, took illegal deductions, and the rest. Looks like Rangel is even a bigger cheat that controls taxes.

Rangel has been lying and avoiding taxes at least for a decade. Usually when a person is caught doing something, there's a history of it before it's recognized. Rangle has over a million dollars of sheltered stuff he didn't claim. He claims it was just an honest oversight. How do you overlook that much money? How did a lifetime politician making a hundred something thousand a year become a multi-millionaire? What did he produce? What business did he manage? What has he contributed? Nothing. He's a leach and the Dems yesterday let him off the hook, and he will not be removed from office and all ethics violations will be dropped. No penalties and no sanctions. Not even a reprimand.

By the way, three RINO's voted to not penalize Rangel, King (NY), Rohrbacher & Young (AK). The final vote was 243-156. 19 voted present. Why do politicians get to vote present? To my mind, you're for something or against it. We need procedural rules. No voting present.

I just don't get either, that corrupt politicos like Rangel, Waters, Corzine, Kennedy (RIP) keep getting re-elected. They're huge cheats, like the governor and legislature of Massachusetts, When Romney was governor, the legislature changed the law so he couldn't appoint to fill and empty senate seat. Now that there's a Dem governor, the legislature gave that power back to the governor to fill Kennedy's seat. Or when Corzine was elected, his predecessor was in big trouble and was going to loose the election. Corzine was drafted, but it was within 50 days, and was illegal to file. State supreme court overruled the law, and Corzine was in. Massive cheating. Okay with politicians, and people elect and re-elect these guys.

Debates, Racism, Nazism, Dems, Republicans

Here's a shotgun blast of observations. The first is racism and the Statists in power. Whenever Dems and other Statists are losing an argument, the charges of racism appear. Of course if you're white, Conservative, Christian, Republican, any or all the above, you are, by definition, a racist; along with being a bigot, sexist, homophobe.
The charges of racism against opponents of the stimulus package and Obamacare are in full swing. Those who oppose this takeover of the private sector by the government do so because Obama is black. Statist economist Paul Krugman: "But they're probably reacting less to what Mr. Obama is doing, or even to what they've heard about what he's doing, than to who he is." Monica Novotny, MSNBC: "The town hall confrontations are turning violent...." (Note that violence didn't occur until the Democrat Party sent SEIU, AFL-CIO and ACORN thugs in.) "New fears for the safety of America’s first African-American president." Chris Matthews: "I think some of the people are upset because we have a black president." Carlos Watson also of MSNBC: ...you start to wonder whether in fact the word socialist is becoming a code word, whether or not socialist is becoming the new N-word for frankly for some angry upset birthers and others." So if you're against the imposition of Marxism and the tossing out of the Constitution, you're a racist.

Since the cowardly, spineless Republican leadership is nowhere to be found during this Great Debate, something must be addressed here. There are always extreme nuts on both sides. Rep. David Scott's (D, GA) district office had a swastika painted on his sign.
This must be denounced immediately by all Conservatives, loudly and repeatly. Both because it's vile, and because the MSM and Dems will use the broad brush to once again paint us as Nazis. Of course the MSM will not say much, if anything, about Scott's racist comments. He's black, in a primarily white district. He claims he's received mail 'using the N word', and calling Obama a Marxist. Scott: "We have got to make sure that the symbol of the swastika does not win, that the racial hatred that's bubbling up does not win this debate." "There's so much hatred out there for President Obama." Statists are losing the argument, so, racist, Nazi, Brooks Brother wearing! and worst of all organized!! labels are applied. Full disclosure: Not I, nor anyone I know, have ever worn a Brooks Brothers suit.

Gene Green, (D, TX), from his website: "Town hall meetings are one of my favorite ways to communicate with constituents. I have held hundreds during my years of service in Congress and always welcomed everyone to attend. Unfortunately, due to a coordinated effort to disrupt our town hall meetings, we will be restricting further attendance to residents of the 29th Congressional District and verifying residency by requiring photo identification. Whether individuals agree or disagree, we must maintain order to have a civil discussion of the issues. While I regret this restriction, it is necessary for the safety and consideration of our constituents. Those who do not reside in the 29th Congressional should contact their Member of Congress to voice any concerns that they may have on issues before Congress." This is from a guy that has voted twice against having voters showing an ID to vote. ummmmmm, anything wrong with this picture?

Of course other Dems and RINO's are starting to have teleconferences by invitation only instead of townhall meetings. Cowards. Cowards and liars. Cowards, liars, Statists. I'm disgusted with the whole lot of them.
